Requesting audio/video records may significantly delay a response, depending on the number of items to be reviewed and/or redacted. Requestors MUST specify particular details of the incident requested to ensure only relevant footage is reviewed. Broad requests for “all recordings” should be avoided. Requests for body camera footage, MVR dash camera footage, and MVR backseat camera footage will NOT be processed unless you identify with your request ALL of the following information:
- the date and approximate time of the law enforcement activity;
- the specific location where the law enforcement activity occurred; and
- the name of at least one individual (other than a law enforcement officer) who was directly involved in the law enforcement activity.
See I.C. 5-14-3-3(i).
The City is required by law to obscure or redact certain depictions and information that may be included in the recording, including, but not limited to, depictions of serious bodily injury, individuals under age 18, personal medical information, and crime victims and witnesses, when necessary for safety. See I.C. 5-14-3-5.2(e).
Effective January 1st, 2026, upon the filing of a complaint by a resident with the Community Police Review Board, the Board Director and the Community Police Review Board will review all recordings relevant to that complaint. Please also note that these records will be subject to additional fees that will be invoiced to the requestor and due prior to receiving these records. Effective January 1st, 2026, the fee per request will be $25.00 per hour, up to $75.00 per recording, based on time spent to search, log, download, review, upload, edit/redact, and process each video associated with the request. If the request includes two videos, the total cost may be up to $150.00. For more information about service fees please visit the City of South Bend's Service Fees for Public Records Request page.
