South Bend Municipal Code: Section 4-60
Definition:
Transient merchant includes any person, firm, partnership, association or corporation which engages in the sale of merchandise in any place in the City on a temporary basis and does not anticipate becoming an established business merchant for a continuous sixty (60) days or longer.
A transient merchant includes anyone who for himself or as an agent for another, rents, erects, purchases, uses, or occupies any vehicle, room, building, or other structure, including but not limited to those located in or along parking lots, shopping centers, sidewalks, or other areas for the purpose of purchasing, selling, or offering for sale anything of value at such location for less than sixty (60) days.

General Instructions
- Assemble all required information and materials before filing application.
- Thoroughly review all applicable Municipal Code Sections listed above.
- Licenses expire January 31.
- Add 10% to license fee for renewal after expiration date.
- Include $5.00 license application fee payable to City of South Bend.
- License fee payable to City of South Bend due at issuance - $135 if business will operate 0-59 days. $50 for Christmas greenery only
- If applicant resides outside the South Bend city limits, they will need to complete a background check form.
Required Information and Materials
- Business information.
- Description of proposed location.
- Description of operation including dates, hours, and types of goods sold.
- Description of proposed advertising.
- Weights and Measures Sealer Certificate (if applicable).
- Information on all group event participants.
- A Certificate of Liability Insurance with the City of South Bend listed as the certificate holder.
Application Process
- Submit Application with $5.00 Processing Fee.
- Review and report by Building Department, Code Enforcement, and Public Works, as applicable.
- Controller Denies or Approves License.
- License issued upon approval and payment of the license fee.
